OtherTarbija ostis kauplusest Fashion Outlet käekoti, millel peale mõningast kandmist kõik 4 nurka ära kulusid ning värv maha tuli. Tarbija leiab, et tegemist ei ole mehaanilise defektiga, vaid tootjapoolse disainiveaga. Kaupleja on tellinud ekspertiisi, mille käigus leiti, et antud defekt on tekkinud välise mehaanilise toimemõju tagajärjel ning kuulub loomulike ekspluatatsioonide defektide liiki. Komisjon asus asja materjalidega tutvumise ja poolte ärakuulamise järel seisukohale, et esitatud tõendid ja eksperdi poolt istungil antud hinnangut arvestades ei ole tõendatud käekoti tootmisvea esinemine. VÕS § 208 lg 4, VÕS § 76 lg 1, VÕS § 217 lg 1 ja lg 2 p 1
