OtherTarbija esitas Kaupleja vastu kahju hüvitamise nõude summas 1583,86 eurot, millest 896,86 eurot on purunenud vinüülparketti väärtus ja 690 eurot eksperdikulu.
Riigikohtu tsiviilkolleegium on 08.01.2013 otsuse nr 3-2-1-173-12 punktis 15 asunud seisukohale, et „ hageja võib VÕS § 115 lg 1 ning §-de 127 ja 128 alusel nõuda kahju hüvitamist, kui on täidetud eelkõige järgmised üldised eeldused:
• kostja on lepingut rikkunud (VÕS § 115 lg 1);
• kostja vastutab lepingu rikkumise eest (VÕS § 115 lg 1), st rikkumine ei ole VÕS § 103 lg 1 järgi vabandatav;
• hagejale on tekkinud või tekib kahju (VÕS § 127 lg 1, § 128);
• kahju on hõlmatud rikutud lepingulise kohustuse kaitse-eesmärgiga (VÕS § 127 lg 2);
• kahju oli rikkumise võimaliku tagajärjena kostjale lepingu sõlmimise ajal ettenähtav, v.a kui kahju tekitati tahtlikult või raske hooletuse tõttu (VÕS § 127 lg 3);
• rikkumise ja kahju vahel on põhjuslik seos (VÕS § 127 lg 4).“
Samale seisukohale asus Riigikohtu tsiviilkolleegium ka 30.09.2015 otsuses nr 3-2-1-100-15. Kahju hüvitamise nõude esitamisel oli Tarbija kohustus tõendada kahju olemasolu, selle suuruse, kahjutekitaja õigusvastase käitumise ning põhjusliku seose olemasolu lepingurikkumise ja kahju vahel (VÕS § 127 lg 4).
Tarbija ei ole esitanud usaldusväärset tõendit, millises koguses vinüülparkett on muutunud kasutuskõlbmatuks. Komisjonile esitatud materjalides on Tarbija väitnud, et osa praaktoodetest viis jäätmejaama, osa on seina ääres. Komisjonil istungil väitis ta, et viis praaktooted maale ja osa on voodi all. Asjaolu, et ta müüs osa vinüülparkette Kauplejale tagasi, ei tõenda, et kogu ülejäänud osa oli kasutuskõlbmatu. Ühtegi akti väidetud praaktoodete koguse kohta ei ole esitatud. Antud asjaolu tõendamise kohustuse oli Tarbijal.

OtherTarbija ostis koos töövõtjaga poest vale vuugisegu ning mis kuivas liiga tumedaks. Töövõtja puhastas vuugid ning täitis need kauplejalt saadud uue vuugiseguga. Kaupleja maksis tarbijale ebameeldiva ostukogemuse hüvitamiseks 500.00 eurot ja andis teise vuugisegu. Tarbija nõuab kauplejalt täiendavalt kahju hüvitamist. Komisjon leiab, et tarbijale üleantud vuugisegu vastas kokkulepitud tingimustele. Tarbija ei ole esile toonud ega tõendanud, et kaupleja oleks andnud üle vuugisegu sellises toonis, mida tarbija ei valinud. Lisaks tooni numbrile oli samal real ka värvi kirjeldus (sinakashall), mida ostja pidi tavalise tähelepanelikkuse juures märkama. Tooni kirjeldusest sinakashall) pidi tarbija, eelkõige aga tarbijat ostuotsuse tegemisel konsulteerinud töövõtja, aru saama, et toonile jääb ka peale kuivamist sinakas varjund. Komisjon peab vajalikuks juhtida tarbija tähelepanu töövõtja hoolsuskohustusele. Komisjon asub seisukohale, et müüja ei ole müügilepingut rikkunud. Tarbija nõue lepingu rikkumisega põhjustatud kahju hüvitamises ei ole põhjendatud ja tuleb jätta rahuldamata.
