Pooltel on võrdne õigus ja võimalus oma nõuet põhjendada ja vastaspoole esitatu ümber lükata või sellele vastu vaielda. Pool määrab ise, mis asjaolud ta oma nõude põhjendamiseks esitab ja milliste tõenditega neid asjaolusid tõendab. Kui kaupleja ei ole avaldusele vastanud, võib asja lahendamisel tugineda üksnes teise poole esitatule ja need asjaolud õigeks lugeda. Kaupleja üleantu ei vasta lepingutingimustele (VÕS § 641 lg 2 p 5). Uste tellimisel ei või need olla vales mõõdus. Kuna uksed on väiksemad, ei ole neid võimalik parandada vaid need tuleb asendada ehk uuesti valmistada. Kuna kaupleja on keeldunud puudust kõrvaldamist võib tarbija tellida kõik uksed kolmandalt isikult, et uksed oleksid sarnased. Kaupleja on enda kohustusi rikkunud (VÕS § 100). VÕS § 647 alusel töövõtja loetakse töövõtulepingut oluliselt rikkunuks muu hulgas siis, kui töö parandamine või uue töö tegemine ei ole võimalik või ebaõnnestub või kui töövõtja õigustamatult keeldub tööd parandamast või uut tööd tegemast või ei tee seda mõistliku aja jooksul pärast talle lepingutingimustele mittevastavusest teatamist. Tarbijatöövõtu puhul loetakse töövõtja lepingurikkumiseks ka töö parandamise või uue töö tegemisega tellijale põhjendamatute ebamugavuste tekitamist. Tarbija on mittevastavusest kauplejale õigeaegselt teatanud. VÕS § 646 lg 5 alusel, kui tellija nõuab õigustatult parandamist ja töövõtja ei tee seda mõistliku aja jooksul, võib tellija töö ise parandada või lasta seda teha ja nõuda töövõtjalt selleks tehtud mõistlike kulutuste hüvitamist. Kaupleja ei ole puudusi kõrvaldanud. Puuduste kõrvaldamise hinnaks võib lugeda hinna, millega kaupleja tarbijale uksed müüs ja paigaldas, seega lepinguhinna. Kahju suurus on tõendatud pooltevahelise lepingu hinnaga. Kui kaupleja oleks paigaldanud õiges mõõdus uksed ja tuulutusavaga ukse, ei oleks tarbijal kahju tekkinud. Seega on kaupleja kohustuse rikkumine ja tarbijale tekkinud kahju (VÕS § 101 lg 1 p 3 ja 127 lg 4) põhjuslikus seoses. Kaupleja rikkumist vabandavaid ega vastutust välistavaid asjaolusid ei ole esitatud.
