OtherPooltevaheline leping lõppes 08.02.2015, mil kaupleja sai tarbijapoolsest lepingu ülesütlemisest teada. Tarbija on nõudele esitanud aegumise vastuväite. Tulenevalt tsiviilseadustiku üldosa seaduse § 146 lg 1: "Tehingust tuleneva nõude aegumistähtaeg on kolm aastat". Tulenevalt tsiviilseadustiku üldosa seaduse § 142 lg 1: "Õigus nõuda teiselt isikult teo tegemist või sellest hoidumist (nõue) aegub seaduses sätestatud tähtaja (aegumistähtaeg) jooksul. Pärast nõude aegumist võib kohustatud isik keelduda oma kohustuse täitmisest". Tarbijal on seadusest tulenev õigus keelduda kaupleja nõude täitmisest. Tarbija kohta võlgnevusest teavitamine ei ole kohane, sest võlgnevus ei ole enam aegumise tõttu sissenõutav. Arvestades, et kaupleja asus 2015 veebruaris tekkinud 4,85 eurost võlga sisse nõudma 2020 jaanuaris ja kulutas selleks 41,46 eurot, ei ole kaupleja enda nõuet õigeaegselt esitanud ja arvestades aegumist on sellise nõude sissenõudmiseks tehtud kulud ebamõistlikud. Arvestades, et kaupleja põhinõue on aegunud ja kaebus jäeti rahuldamata,, ei kuulu rahuldamisele ka nõude sissenõudmise kulude hüvitamise nõue.
