OtherTarbija ostis kauplejalt tiikpuidust terrassimööbli - söögilaua ja 8 tooli. Mõne aja pärast avastas tarbija kolmel toolil defektid - kahel toolil olid tekkinud praod ning ühel toolil oli läinud lipp katki. Tarbija leiab, et kuna laud ja toolid olid soetatud komplektina, soovib ta et kaupleja asendaks kogu mööbli uuega või tagastaks raha. Tarbija nõuet kogu terrassimööbli eest tasutud summa tagastamiseks ei pea komisjon põhjendatuks. Tarbija pole tõendanud, et soetatud laud ja 8 tooli olid müügis komplektina. Käesoleval juhul mööbli eest tasumiseks esitatud arvel on toolidel ja laual märgitud erinevad tootekoodid ja iga ühiku maksumus on eraldi välja toodud. Komisjoni hinnangul on tegemist mööbliesemetega, mida saab kasutada nii koos kui ka eraldi. VÕS § 208 lg 4, VÕS § 217 lg 1 ja lg 2 p 1, VÕS § 223 lg 1
