OtherTarbija tütar alustas kaupleja autokoolis käimist aastal 2019. Ta osales autokooli teooria tundides (2019 ja 2020). Autokooli eksamiaeg lükkus tervislikel põhjustel edasi. Suvel 2022 käis tarbija tütar sooritamas autokooli teooria eksamit, mille eest tarbija pidi tasuma 500 eurot. Tarbijale öeldi, et käesoleval aastal autokool enam ei tegutse. Tarbija soovis saada tasutud 1000 eurot tagasi. Kaupleja ei nõustunud avaldusega a leidis, et lepingu ütles üles tarbija. Komisjon ei nõustus kaupleja väitega, et käsunduslepingu ütles üles tarbija. Komisjoni hinnangul oli üles ülesütlejaks kaupleja, kes ei võimaldanud kliendil vaatamata teadmiste kontrollis põrumisele rohkem katseid sooritada. Komisjon märgib, et istungil kaupleja esindaja tunnistas, et kordade arv polnud suulise lepingu kohaselt piiratud. Seega pidi kaupleja kliendi soovi korral võimaldama tal jätkata teadmiste kontrollide läbimist kuni positiivse soorituseni. Komisjon märkis, et tarbija tütar siiski osales tundides 2019. ja 2020. aastal. Komisjoni hinnangul, vaatamata sellel, et ta ei sooritanud koolieksamit, omandas ta teooria tundides vajalikke teadmisi, mida saab kasutada tulevikus mõnes teises autokoolis. Komisjon leiab seetõttu, et kogu koolitusraha 1000 euro välja mõistmine ei ole kooskõlas VÕS § 629 lg 3 sätestatud põhimõttega. Komisjon kasutas diskretsiooniõigust ning rahuldas tarbija avalduse osaliselt ning mõistis kauplejalt välja poole tarbija poolt soovitud summast 500 euro ulatuses.
