OtherTarbija sõlmis kauplejaga töövõtulepingu sõiduki mootoriõli- ja filtri vahetuseks. Pärast sõiduki kätte saamist avastas tarbija õlilekke. Kaupleja viis oma kuludega sõiduki töökotta tagasi ning tuvastas, et lekkis käigukasti kork. Tarbija viis sõiduki Moller Auto Ülemiste esindusse, kus katkine kork vahetati. Ühtlasi kinnitas Moller Auto Tallinn OÜ tarbijale esitatud arvel, et korgi vahetusel ja kaupleja poolt teostatud mootori õlivahetusel puudus omavaheline seos. Nii kohtus (TsMS § 230) kui vaidluste kohtueelsel lahendamisel peab asjaolu, millele ta tugineb, tõendama see pool, kes asjaolule tugineb. Komisjoni hinnangul ei tõenda tarbija väited, et lekkival käigukasti korgil vastupidiselt Moller Auto Tallinn OÜ poolt tuvastatule põhjuslik seos. Tarbija pole komisjonile asjakohaseid tõendeid esitanud. Ülaltoodust tulenevalt jättis komisjon tarbija avalduse tõendamatuse tõttu rahuldamata.

Komisjon rahuldas Tarbija avalduse ja kohustas Kauplejat Tarbijale üle andma 4 kasutatud, aga töökorras parkimisandurit, mis ei ole vanemad kui 8 aastat.

Keskkonnaamet avaldab teadaande keskkonnaseadustiku üldosa seaduse (KeÜS) § 58 lõike 3 alusel.

Keskkonnaamet teatab, et Osaühing Reval Group (registrikood: 10326671) (aadress Ädala 11, 10614 Tallinna linn, Harju maakond) väljastati tähtajatu kehtivusega muudetud õhusaasteluba nr L.ÕV/323417.

Õhusaasteluba väljastatud mootorsõidukite remonditöödele, mis toimuvad aadressidel Mäealuse 1 ja Mäealuse 1a, Tallinn. Heiteallikateks on maagaasil töötavate katelde korstnad ja värvikambrite korstnad. Põletusseadmete soojussisendile vastav summaarne nimisoojusvõimsus on 0,819 MW ning maagaasi aastane kulu 100 tuh m³. Autode remondiks lahusteid sisaldavate materjalide (värvid, lakid, lahustid jm) aastakulu on 4,562 tonni, millest välisõhku eraldub 2,245 tonni.

Saasteloaga kavandatava tegevusega eeldatavalt ei kaasne olulist keskkonnamõju. Saasteainete sisaldused välisõhus tootmisterritooriumi piiril jäävad alla kehtestatud saastatuse taseme piirväärtusi. Keskkonnamõju hindamise ja keskkonnajuhtimise seadus § 6 lg 1 alusel ei kuulu ettevõtte tegevus olulise keskkonnamõjuga tegevuste hulka, mille korral on keskkonnamõju hindamine kohustuslik.
