OtherTarbija soovis Kauplejalt maksimaalselt helikindlaid aknaid, aga loobus maksimaalse helikindluse nõudest ning aktsepteeris helikindlamate akende hinnapakkumist, kuhu ei olnud helisolatsiooni määra märgitud. Peale lepingu täitmist esitas Tarbija pretensiooni, et aknad ei ole helikindlad ja soovis lepingust taganeda. Tõendatult oli akende heliisolatsioon enne vahetamist 31db ja uutel akendel 41dB. Seega on uued aknad helikindlamad ja vastavad müügilepingu tingimustele ning Tarbija lepingust taganemise avaldus jäi rahuldamata.
