Sisu:Vaidluse asjaolude kohaselt tellis tarbija kauplejalt prillid koos klaaside ja silmakontrolliga. Tootel ilmnes defekt ning tarbija nõudis lepingu täitmist. Kaupleja hinnangul on asja puuduse näol tegemist mehaanilise vigastusega. Tarbija leidis, et talle on tekitatud kahju ning nõudis selle hüvitamist. Komisjoni hinnangul ei ole kaupleja oma seadusest tulenevat tõendamiskoormist täitnud ning vaidlusaluse defekti näol on tegemist asja puudusega. Komisjon otsustas rahuldada osaliselt tarbija nõude. Vastavalt 07.12.2017. a. sõlmitud jagunemiskavale toimus Osaühingu Eesti Optik (jagunev ühing) jagunemine eraldumise teel, mille tulemusena läks osa Osaühingu Eesti Optik varast üle jagunemiskava alusel ja kohaselt asutatud OÜ-le Eesti Optik Kinnisvara (omandav ühing).

Äriühingute võlausaldajatel palume esitada oma nõuded tagatise saamiseks kuue kuu jooksul käesoleva teate avaldamisest (ÄS § 447 lg 21).
