OtherOstetud hüdrotõstuki paigaldamisel selgus, et tõstuki tõstekõrgus ei vasta kaupleja poolt välja reklaamitud tõstekõrgusele ning sellest tulenevalt soovis tarbija lepingust taganeda. Kaupleja on nõus tõstuki tagasi ostma, kuid keeldub paigalduse eest raha tagastama. Komisjoni hinnangul ei ole kaupleja seisukoht õige, mille järgi müüki ja paigaldust tuleb vaadelda eraldiseisvate lepingutena. Tuginedes asja materjalidele oli hüdrotõstuki paigaldus üheks kaupleja müügilepingu järgseks kohustuseks ning lähtudes sellest tuleb tarbija nõue rahuldada. VÕS § 208 lg 4, VÕS § 218 lg 2, VÕS § 189 lg 1
