Tartu Maakohus (Tartu kohtumaja) avaldab teadaande pankrotiseaduse (PankrS) § 33 lõike 1 alusel.

25.09.2023 kohtumäärusega tsiviilasjas nr 2-23-2972/19 kuulutati välja võlgniku, AS WIPESTREX GRUPP (registrikood: 10490620),  pankrot 25.09.2023 kell 16.30.

Pankrotihalduriks nimetati Jüri Truuts (aadress Jõe 2, II korrus, 10151 Tallinn, telefon 502 6222, e-post truuts@autente.ee).

Esimene võlausaldajate üldkoosolek toimub 11.10.2023 algusega kell 13.00 Tartu Maakohus Tartu kohtumaja saalis nr 344.

Võlausaldajad on kohustatud hiljemalt kahe kuu jooksul pankrotiteate väljaandes Ametlikud Teadaanded ilmumise päevast teatama pankrotihaldurile kõigist oma enne pankroti väljakuulutamist tekkinud nõuetest võlgniku vastu, sõltumata nõude tekkimise alusest ja nõude tähtajast (PankrS § 93 lg 1). Tähtaegselt esitamata, kuid tunnustatud nõuded rahuldatakse viimases järgus (PankrS § 153 lg 1 p 3). Pankrotivarasse kuuluva võlgnikule võlgnetava kohustuse täitmist võib pärast pankroti väljakuulutamist vastu võtta üksnes pankrotihaldur (PankrS § 37).
 
Pankrotimäärus kuulub viivitamatule täitmisele (PankrS § 31 lg 7). Võlgnik ja pankrotiavalduse esitanud võlausaldaja võivad esitada määruskaebuse 15 päeva jooksul teate avaldamisest arvates (PankrS § 32). Määruskaebuse esitamine ei peata määruse täitmist (PankrS § 5 lg 3). Pankrotimääruse täitmist ei saa peatada ega ajatada, samuti ei saa muuta pankrotimääruse seaduses sätestatud täitmise viisi ja korda (PankrS § 31 lg 7).

Tartu Maakohus (Tartu kohtumaja) avaldab teadaande pankrotiseaduse (PankrS) § 30 lõike 2 alusel.

16.06.2023 kohtumäärusega tsiviilasjas nr 2-23-2972/14 määrati võlgniku, AS WIPESTREX GRUPP (registrikood: 10490620), pankrotiavalduse menetluse raugemise vältimiseks pankrotimenetluse kulude deposiidina selleks ettenähtud kontole makstava summa suuruseks 4000 eurot ja maksmise tähtajaks 10.07.2023.

Pankrotiavaldusega on võimalik tutvuda Tartu kohtumaja kantseleis (Kalevi 1, Tartu, III korrus) või ajutise halduri Jüri Truutsi (Jõe 2, II korrus, 10151 Tallinn; telefon 502 6222) juures. Kohus ei lõpeta menetlust, kui pankrotimenetluse kulude katteks makstakse deposiidina kohtu määratud summa.

Summa tuleb tasuda Rahandusministeeriumi arvelduskontole nr EE571010220229377229 (SEB Pank), nr EE062200221059223099  (Swedbank) või nr EE221700017003510302 (Luminor Bank). Selgitusse märkida menetluskulud, tsiviilasi 2-23-2972. Maksmist tõendav dokument esitada või maksmisest teatada määratud tähtpäevaks kohtule (maksja nimi, tsiviilasja number, tasumise kuupäev).

Käsutuskeelu teatavakstegemise teade

Tartu Maakohus (Tartu kohtumaja) avaldab teadaande pankrotiseaduse (PankrS) § 21 lõike 1 alusel.

17.05.2023 kohtumäärusega nr 2-23-2972/10 keelati võlgnikul, AS WIPESTREX GRUPP (registrikood: 10490620), ajutise pankrotihalduri nõusolekuta kogu vara käsutada (PankrS § 20 lg 1). 1. Nimetada AS-le WIPESTREX GRUPP (registrikood 10490620; asukoht Sõbra 58, 50106 Tartu) ajutiseks pankrotihalduriks Jüri Truuts (isikukood 37001240323; Jõe 2, II korrus, 10151 Tallinn; telefon 502 6222; e-post truuts@autente.ee) ning teha talle kohustuseks PankrS § 22 lõigetest 2 ja 5 tulenevate ülesannete täitmine.2. Peatada võlgniku vara suhtes toimuvad sundtäitmised.3. Pankrotiavalduse tagamiseks keelata AS-l WIPESTREX GRUPP (registrikood 10490620) ajutise halduri nõusolekuta kogu vara käsutada.4. Ajutisel halduril esitada PankrS § 22 lõikes 2 nimetatud ülesannete täitmise kohta kohtule kirjalik aruanne ja arvamus võlgniku maksejõuetuse tekkimise põhjuste kohta 9. juuniks 2023.5. Käesolev kohtumäärus on tehtud maksejõuetuse põhimenetluses ning määrust on kohustatud tunnustama kõik teised liikmesriigid Nõukogu määruse (EL) nr 2015/848 art 19 alusel.Määrus toimetada kätte võlausaldajale, võlgnikule ning täitmiseks ajutisele pankrotihaldurile. Edastada määrus Tartu Maakohtu registriosakonnale. Teadaanne käsutuskeelu kehtestamise kohta avaldada väljaandes Ametlikud Teadaanded.
