OtherTarbija ostis kauplejalt abielusõrmused. Naiste sõrmus purunes enne kahe aasta möödumist kaheks osaks. Kaupleja võttis sõrmuse ekspertiisi ning saatis Prantsusmaale. Postiteenuse osutamise käigus jäid sõrmuse tükid kadunuks. Komisjon rahuldas avalduse ning mõistis tarbija kasuks välja rahalise hüvitise. Komisjon leidis, et kaupleja vastutab tarbija ees TsÜS § 132 lg 2 kohaselt ka ajal, mil sõrmuste tegelik valdus oli postiteenuse osutajal. Komisjon märkis, et kauplejast tulenevate asjaolude tõttu polnud võimalik kindlaks teha sõrmuse purunemise tegelikke asjaolusid, mistõttu komisjon mõistis VÕS § 132 lg 1 alusel välja uue samaväärse abielusõrmuse soetamise kulu.
