OtherKomisjon ei nõustu tarbijaga selles, et maakleri poolt osutatud üürnikuga üürilepingu sõlmimata jäämine vabastas tarbija tasu maksmise kohustusest. Maaklerilepingust ei teki käsundiandja kohustust leping sõlmida. Maakleritasu saamine VÕS § 664 lg 1 mõttes eeldab, et maakleri panuse tulemusena on käsundiandjal võimalus sõlmida maakleri vahendatud või osutatud kolmanda(te) isiku(te)ga leping. VÕS § 664 tuleb tõlgendada viisil, et käsundiandja ei või vabaneda maakleritasu maksmise kohustusest üksnes seetõttu, et ta enesest lähtuvatel subjektiivsetel kaalutlustel loobub üürilepingu sõlmimisest.

Kaupleja ei olnud nõus puudust kõrvaldama enne arve eest tasumist. Sellist nõuet ei saa lugeda õiguspäraseks. Kaupleja väide on õige, et ta ei pea nõustuma Tarbija hinnanguga kinnistu väärtusele, kuid hindamisaktis olevad andmed peavad vastama tegelikkusele ning oma hinnangut tuleb põhjendada õigetele andmetele tuginedes. Komisjon leidis, Tarbija et avaldus kuulub rahuldamisele.

OtherTarbija soovis osta korterit ning sõlmis lepingu maakleriga korteri müügipakkumise peatamiseks ning valduse ajutiseks üleandmiseks. Tarbija väitel oli suuline kokkulepe ka remondi alustamiseks, kuid hiljem seda siiski teha ei lubatud ning tarbija soovis kokkuleppest taganeda ning nõudis lepingust tuleneva tasu tagastamist. Kaupleja tagastas 50% ettemaksust ning avaldas uuesti müügikuulutuse enne kokkulepitud perioodi lõppemist. Komisjoni hinnangul puudus tarbijal lepingust taganemiseks alus.
