      Sisu:06.01.2022 purunes tarbija sõidukil BMW 520 Touring xDrive tagumine rehv ja ta tellis puksiirabi sõiduki toimetamiseks BMW teenindusse. Tarbija juhtis puksiirauto juhi tähelepanu, et sõidukit tohib vedada kõik rattad veokil, tegemist on nelikveoga ja automaatkäigukastiga sõidukiga, kuid puksiirauto juht vedas sõiduki sihtkohta esiteljel. Sõiduki margiesindus Inchcape Motors Estonia OÜ tuvastas vahekasti rikke ja et selle on tõenäoliselt põhjustanud sõiduki nõuete vastane transportimisviis. Tarbija lasi sõiduki remontida ning esitas kauplejale remondikulude hüvitamiseks. Lisaks tekkis tarbijal kahju 10.01. ja 18.01.2022 lennupiletite maksumuse näol, kokku 611,60 eurot. Kaupleja leidis, et kahju ei tekkinud tema süül. Komisjon leidis, kahju tekkis kaupleja poolt valesid töövõtteid kasutades. Seda kinnitab üheselt BMW 5-seeria 2015. aasta mudeli manuaal. Komisjon rahuldas remondikulude nõude. Lennupiletite nõude jättis komisjon rahuldamata, kuna komisjoni hinnangul oli tegemist puhtmajandusliku kahjuga.

      Sisu:VÕS § 91 järgi võib rahalise kohustuse täita sularahas või ka muul viisil, kui see on poolte poolt kokku lepitud või kui seda kasutatakse tasumise kohas tavaliselt majandustegevuses. Kui võlausaldajal on krediidiasutuses või muu makseteenuse pakkuja juures konto, mis on määratud maksetehingute tegemiseks, võib võlgnik kohustuse täita võlgnetava summa kandmisega sellele kontole, kui võlausaldaja ei ole seda otseselt keelanud. Eestis on kohustuste täitmine maksekontole majandustegevuses tavaline; kõnealusel juhul ei ole kaupleja otseselt keelanud täitmist maksekonto kaudu ja kauplejal puudub selliseks keeldumiseks ka õigustatud huvi. Võlgniku maksekohustus ei saa iseenesest suureneda valitud makseviisi põhjendusel. Kasutatav makseviis ei ole lisateenus. Kui teenuse pakkujal on konto või sularaha haldamisega seonduvad kulutused, tuleb need kalkuleerida teenuse lõpphinna sisse. Hinnastamine tulenevalt makseviisist viitab ebavõrdsele ja ebaõiglasele kohtlemisele.

      Tartu Maakohtu registriosakond avaldab teadaande äriseadustiku (ÄS) § 60 lõike 2 alusel.

      OÜ ME Holding (registrikood: 10844029) ei ole esitanud 2013., 2014. aasta majandusaasta aruannet ega esitanud registripidajale mõjuvat põhjust, mis takistab tal aruannet esitamast kuue kuu jooksul alates kustutamishoiatuse (määruse nr Ä 20022783 / M3) tegemisest.

      Kõigil võlausaldajatel on võimalik teatada oma nõuetest äriühingu vastu ja taotleda likvideerimismenetluse läbiviimist kuue kuu jooksul alates käesoleva teate avaldamisest. Vastasel korral võidakse äriühing registrist kustutada likvideerimismenetluseta (ÄS § 60 lg 2).

      Kui äriühingu võlausaldaja või äriühing esitab käesoleva teate avaldamisest alates kuue kuu jooksul äriühingu likvideerimise taotluse, otsustab registripidaja äriühingu sundlõpetamise (ÄS § 60 lg 4).

      Kui äriühing ei ole kuue kuu jooksul alates käesoleva teate avaldamisest esitanud registripidajale majandusaasta aruannet ega esitanud ja põhistanud registripidajale mõjuvat põhjust, mis takistab tal aruannet esitamast, ning äriühingu võlausaldajad ei ole taotlenud äriühingu likvideerimist, võib registripidaja äriühingu äriregistrist kustutada (ÄS § 60 lg 3).
