OtherTarbija tellis internetiportaali vahendusel Kauplejalt hinnapakkumise 100 ruutmeetri pööningu soojustamiseks klaaspuistevillaga 40cm paksuse kohiga. Kaupleja tegi hinnapakkumise ning paigaldas tarbija soovil Tarbija objektile puistevilla 28 kotti, kuid tarbija soovis lisaks hinna sees veel 12 koti paigaldamist vastavalt tootja juhistele. Kaupleja hinnangul paigaldati lepinguga kokkulepitud kogus villa, kuid alandas lepinguga kokku lepitud hinda. Tarbija hinna alandamisega ei nõustunud ning soovis täiendavalt 12 koti villa paigaldamist. Komisjoni hinnangul teostas kaupleja töö vastavalt lepingule, puuduvad tõendid lepingu rikkumise kohta ning tarbija nõuet ei rahuldatud. VÕS § 635 lg 4, § 641 lg 1 ja lg 2 p 1, § 642 lg 2, TKS § 9 lg 1.
