Kaupleja tüüptingimuste p 8.4.1 piirab kaupleja kahju hüvitamise kohustust välistades tarbija õiguse nõuda lepingurikkumise korral kahju hüvitamist siis, kui pakk toimetatakse saajani 30 päeva jooksul kokkulepitud tähtajast. Komisjon leiab, et kaupleja kasutatav tüüptingimus p 8.4.1 on tühine VÕS § 41 lg 3 p 2 alusel, kuna piirab tarbija õiguskaitsevahendite kasutamist kaupleja olulise lepingurikkumise korral ja seda ei saa kohaldada. Arvestades, et kokkulepitud teenuse täitmise aeg oli 5 tööpäeva ja seda ületati mitmekordselt, piirab see lepingutingimus kaupleja vastutust olulise lepingurikkumise korral. Mitmekordne tähtaja rikkumine on käsitatav olulise lepingurikkumisena (VÕS § 116 lg 2 p 1). Kui tarbija eeldas, et pakk jõuab kohale 5 tööpäevaga kuid tegelikkuses jõudis see kohale ligi 30 päevaga, jäi tarbija olulisel määral ilma sellest, mida ta õigustatult lepingust lootis. Tarbija pidi tegema täiendavaid sooritusi, et sundida kauplejat lepingut täitma, pakki otsima ja tarbija pidi tuvastama kaupleja poolt leitud sildita paki sisu. Tarbija avaldust hinnates seisneb tarbija kahju selles, et tarbijale tekkisid ebamugavused ja saadud teenuse kvaliteet ei vastanud kokkulepitule. Kahju tekkimine on esitatud asjaoludega tõendatud. Kaupleja põhjustatud ebamugavuste (kahju) väärtus on komisjoni hinnangul (TsMS § 233 lg 1) vähemalt 15,24 eurot. Täiendavate tõendite esitamine ebamugavuse ja täiendava suhtluse kohta ei ole vajalik, kuna kaupleja ei ole neid asjaolusid vaidlustanud. Kaupleja on kohustust rikkunud (VÕS § 100) ja see on põhjustanud tarbijale kahju (VÕS § 115, 132), mis väljendus täiendavas asjaajamises ja ebamugavuses. Tekkinud kahju on põhjuslikus seoses kaupleja rikkumisega ning kaupleja rikkumist vabandavad asjaolusid ja kaupleja vastutust välistavad asjaolud puuduvad.

OtherTarbija tellis kauplejalt pakiveoteenuse. Teenuse osutamise käigus sai pakendis olnud kaup kahjustada. Tarbija leidis, et kauba purunemine on toimunud kaupleja süül ning nõudis kauplejalt kahju hüvitamist. Komisjon leidis, et tarbija ei ole kauba pakendamisel järginud kaupleja üldtingimustes toodud juhiseid ning kaup on purunenud selle ebakohase pakendamise tõttu. Komisjon jättis tarbija kaebuse rahuldamata.
