Avaldamise lõpp: pankrotimenetluse lõppemiseni
09.10.2023 kohtumäärusega nr 2-23-12046 tühistati võlgnikule, OÜ Real Estate Builders (registrikood: 11198519, aadress: Harju maakond, Tallinn, Kesklinna linnaosa, Rävala pst 3, 10143), 31.08.2023 kohtumäärusega nr 2-23-12046 kehtestatud käsutuskeeld. 09.10.2023 kohtumääruse resolutsiooni väljavõte:
Jätta OÜ Real Estate Builders avaldus pankroti väljakuulutamiseks läbi vaatamata.
Tühistada käesoleva määruse jõustumisel 31.08.2023 määrusega määratud pankrotiavalduse tagamise abinõud, millega kohus keelas OÜ-l Real Estate Builders ajutise pankrotihalduri nõusolekuta vara käsutada.
Vabastada ajutine pankrotihaldur Martin Krupp käesoleva määruse jõustumisel OÜ Real Estate Builders pankrotiavalduse menetluses tema ülesannetest.

Notice of Prohibition of Disposal
Avaldamise lõpp: pankrotimenetluse lõppemiseni
31.08.2023 kohtumäärusega nr 31.08.2023 Menetlusse võtmise määrus 2-23-12046/6 keelati võlgnikul, OÜ Real Estate Builders (registrikood: 11198519), ajutise pankrotihalduri nõusolekuta kogu vara käsutada (PankrS § 20 lg 1). Kohtumääruse resolutsioon: 1. Võtta OÜ Real Estate Builders avaldus pankroti väljakuulutamiseks menetlusse. 2. Nimetada ajutiseks pankrotihalduriks Martin Krupp. 3. Vaadata pankrotiavaldus läbi kirjalikus menetluses. 4. Peatada võlgniku vara suhtes toimuv sundtäitmine. 5. Keelata võlgnikul ajutise pankrotihalduri nõusolekuta vara käsutada. 6. Teha ajutisele pankrotihaldurile ülesandeks: selgitada välja võlgniku vara, sealhulgas võlgniku kohustused, ning kontrollida, kas võlgniku vara katab pankrotimenetluse kulud; anda hinnang võlgniku varalisele seisundile ja maksejõulisusele, samuti võlgniku ettevõtte tegevuse jätkamise ja juriidilisest isikust võlgniku tervendamise väljavaadetele; selgitada välja võlgniku vara puudutavad täitemenetlused; tagada võlgniku vara säilimine; anda võlgnikule nõusoleku vara käsutamiseks või keelduda sellest; vajadusel taotleda kohtult pankrotiavalduse tagamise abinõude rakendamist, teavitada PankrS § 29 lõikes 1 nimetatud juhul teadaolevaid võlausaldajaid PankrS § 30 kohaselt pankrotimenetluse kulude katteks raha deposiiti kandmise võimalusest. 7. Ajutisel pankrotihalduril tegutseda pankrotimenetluse ettevalmistamisel PankrS § 22 lg-te 2-5 järgi ning esitada hiljemalt 15.09.2023 kohtule kirjalik aruanne ja arvamus võlgniku maksejõuetuse tekkimise põhjuste kohta, ühes märkusega selle kohta, kas maksejõuetuse põhjuseks on kuriteo tunnustega tegu, raske juhtimisviga või muu asjaolu. 8. Avaldada väljavõte käesolevast määrusest väljaandes Ametlikud Teadaanded. 9. Toimetada käesoleva määruse ärakiri kätte võlgnikule ja ajutisele haldurile ning edastada Tartu Maakohtu registriosakonnale.
