Decision:Tarbija kahjuks
OtherKomisjon jättis tarbija avalduse rahuldamata. Poolte vahel sõlmitud krediidikonto lepingu puhul sõltus tegelik intressikulu kasutatud krediidisummast ja krediidi kasutamise ajast ning lepingus märgitud krediidi kogukulu ei olnud viieks aastaks ette kindlaks määratud intressisumma. Menetluses esitatud arvestuse põhjal ei olnud tarbija krediidi põhiosa täielikult tagastanud ning komisjon ei tuvastanud kaupleja arvestuses viga. Samuti ei ületanud krediidi kulukuse aastamäär seaduses sätestatud ülempiiri. Komisjon kontrollis lisaks vastutustundliku laenamise põhimõtte järgimist ning leidis, et kaupleja oli enne krediidi andmist ja krediidilimiidi suurendamist kontrollinud tarbija sissetulekuid, kohustusi, majapidamiskulusid ja maksekäitumist ning menetluses ei ilmnenud alust järeldada, et krediidivõimelisust oleks hinnatud puudulikult.

Decision:Tarbija kasuks
OtherKOHTUSSE. Komisjon leidis, et kaupleja rikkus kõigi vaidlusaluste tarbijakrediidilepingute sõlmimisel vastutustundliku laenamise põhimõtet, kuna ei hinnanud tarbija krediidivõimelisust nõuetekohaselt. Kuigi kaupleja kogus teatud andmeid ja tugines mh keskmisele sissetulekule ning suhtarvudele, ei arvestanud ta piisavalt tarbija tegelikku majanduslikku olukorda, sealhulgas ebaregulaarsest sissetulekust, sotsiaaltoetustest ning konto väljavõttest nähtuvast pingelisest rahavoost tulenevaid riske. Konto andmed näitasid, et tarbijal puudus püsiv rahaline puhver ning igakuine vaba raha oli sisuliselt olematu, mistõttu ei olnud põhjendatud järeldada, et tarbija on krediidivõimeline.Kuigi varasemad lepingud refinantseeriti, leidis komisjon, et ka selle lepingu aluseks olnud kohustused olid kujunenud õigusvastaselt. Seetõttu kohaldas komisjon kehtivale lepingule võlaõigusseaduse § 403⁴ lg 7 tagajärge, mille kohaselt asendub kokkulepitud intress seadusjärgse intressiga. Kauplejale pandi kohustus teha uus arvestus, võttes arvesse intressi ja kulude vähendamist.
