OtherPooled sõlmisid üürilepingu, mille sisu oli peokoha üürimine. Tasuti ettemaks summas 500 eurot. Esitatud asjaolude ja tõendite kohaselt ei sisaldunud lepingus kokkulepet, et toitlustamist peab tellima üürileandjalt, samuti ei olnud kokkulepet, et kui toitlustamist üürileandjalt ei tellita, siis tuleb maksta lisatasu. Kaupleja esitatud vastusest tulenevalt selgub, et kaupleja küsis tarbijalt täiendavat tasu. Seepeale taganes tarbija lepingust. Esitatu kohaselt loobus kaupleja pärast tarbija lepingust taganemist täiendava tasu nõudmisest. See ei muuda tarbija esitatud taganemisavaldust ega selle alust. Lepingust võib taganeda vastavalt VÕS § 116 olulise lepingurikkumise korral. § 116 lg 2 p 2-4 kohaselt on olulised lepingurikkumised: - rikuti kohustust, mille täpne järgimine oli lepingust tulenevalt teise lepingupoole huvi püsimise eelduseks lepingu täitmise vastu; - kohustust rikuti tahtlikult või raske hooletuse tõttu; - kohustuse rikkumine annab kahjustatud lepingupoolele mõistliku põhjuse eeldada, et teine lepingupool ei täida kohustusi ka edaspidi. Esitades täiendava tasu nõude rikkus kaupleja kokkulepet üüritasu suuruse ja üürilepingu tingimuste osas. Üüri suurus on üürilepingu oluline tingimus ja kui üürileandja asub nõudma kokkulepitust suuremat summat, on tegemist olulise lepingurikkumisega. Algselt ei olenud pooltel kokkulepet, et toitlustajaks on üürileandja lepingupartner, kaupleja vastuse kohaselt selgitas kaupleja, missugused toitlustajad on kaupleja lepingupartnerid ja esitas tingimuse, et kui neid ei kasutata, tuleb maksta lisatasu. Kaupleja esitas lepingule esialgselt avaldatud teabega võrreldes olulisi lisatingimusi, kaupleja oleks pidanud sellistest lisatingimustest teavitama enne lepingu sõlmimist. Arvestades kaupleja esitatud täiendavaid tingimusi (lepingu oluliste tingimuste muutmise nõue) ja korraldatava ürituse olulisust üürniku jaoks võis üürnik(tarbija) mõistlikult eeldada, et teine lepingupool ei täida enda kohustusi ka edaspidi. Tarbija esitatud lepingtust taganemise avaldus on kehtiv ja tarbijal on kaupleja vastu ettemaksu tagastamise nõue VÕS § 189 alusel.

Maksu- ja Tolliamet avaldab teadaande maksukorralduse seaduse (MKS) § 55 alusel.

Menetlusosalisele Osaühing KORNER AK (registrikood: 11205248) toimetatakse kätte 17.12.2024 korraldus nr 12.2-3/065620-1, kus Maksu- ja Tolliamet on kohustanud Osaühing KORNER AK-d andma kirjalikku teavet ja esitama tõendid ettevõtlusega tegelemise kohta hiljemalt 30.12.2024 Maksu- ja Tolliametile aadressil Lõõtsa 8a, 15176 Tallinn.

Dokumendi resolutiivosa loetakse kättetoimetatuks kümne päeva möödumisel käesoleva teadaande avaldamisest (MKS § 55).
