Sisu:Pooled sõlmisid kehtiva ehituse töövõtulepingu. Tarbija on kauplejale lepingu hinna tasunud, kuid kaupleja töös ilmnes puudus ja tekkis leke. Kaupleja ei kõrvaldanud puudust mõistliku aja jooksul, ehkki talle see võimalus anti. Tarbija on esitanud puuduse kohta asjatundja arvamuse. Esitatud arvamus on arusaadav ja usaldusväärne. Kaupleja vaidleb tuvastatud puudustele vastu paljasõnaliselt. Enda esitatud asjaolude tõendamise kohustus lasub kauplejal. Kaupleja ei ole nõude summat vaidlustanud. Kaupleja ei ole asjatundja arvamuse vajalikkust ega selle kulusid vaidlustanud. Tulenevalt võlaõigusseaduse (VÕS) § 635 oli kauplejal kohustus teha kokkulepitud töö ja see peab vastama kvaliteedinõuetele (VÕS § 641 lg 1 ja lg 2 p 2). Puudub vaidlus, et torustiku paigaldas kaupleja ja see hakkas lekkima. Tarbija teatas lekkest kauplejale õigeagselt, kauplejal oli võimalus puudus kõrvaldada. Kaupleja pidi tegema töö nii, et torustik ei hakka 12 kuu möödudes lekkima. Kuna leke on tuvastatud ja selle põhjus tõendatud, on kaupleja töö olnud nõuetele mittevastav, ehk kaupleja on oma kohustust rikkunud (VÕS § 100), jättes kokkulepitud töö kvaliteedi tagamata. Tarbijal on õigus kasutada õiguskaitsevahendina kahju hüvitamise nõuet (VÕS § 101 lg 1 p 3). Tarbija on lepingu hinna kauplejale tasunud kuid ei ole saanud lepingule vastavat sooritust - kokkulepitud kvaliteediga tööd. Tarbijale on tekkinud kahju seeläbi, et tarbija peab selle tulemuse saavutamiseks, mille ta pidi saama kauplejapoolse lepingu täitmise korral, tegema täiendavaid kulusid. Lisaks pidi tarbija puuduse põhjuse kindlakstegemiseks tegema täiendava kulutuse. Seega on tarbijale tekkinud kahju põhjuslikus seoses kaupleja kohustuse rikkumisega. Kahju hüvitamise eesmärk (VÕS § 127) on kahjustatud isiku asetamine olukorda, milles ta oleks olnud juhul, kui teise poole kohustuse rikkumist ei oleks esinenud. Tarbija soovib hüvitisega saavutada olukorda, milles ta oleks olnud juhul, kui kaupleja ei oleks lepingut rikkunud. Nõude summade osas vaidlus puudub. Komisjon hindab puuduse kindlakstegemiseks arvamuse tellimist vajalikus, kuna vastasel juhul ei oleks tarbijal olnud võimalik enda nõuet tõendada. Samuti oli vajalik kulutuse tegemine lekke kõrvaldamiseks. Kaupleja rikkumist välistavaid ega rikkumist vabandavaid asjaolusid ei ole esitatud. Poolte vaidluses on tõendamise kohustus sellel, kes esitab mingi asjaolu, seda sätestab tsiviilkohtumenetluse seadustiku § 230 lg 1 ning antud põhimõte rakendub ka vaidluste kohtueelsel lahendamisel.
