Decision:Tarbija kahjuks

Sisu:Tarbija nõue on, et komisjon kohaldab kaupleja suhtes trahvi. Komisjonil ei ole väärteomenetluse pädevust. Trahvi saab tarbijakaitseaseaduses sätestatud rikkumise korral määrata TTJA. Tarbija soovib, et komisjon tuvastaks kaupleja kohustuse lepingu sõlmimiseks. Tarbija nõudel puudub alus. Õigusaktid ei kohusta treeningsaali omanikku või valdajat, kes pakub treeninguvõimalusi, pakkuma seda igale isikule ja sõlmima kõigi isikutega lepinguid. VÕS § 8 lg 1 kohaselt on leping tehing kahe või enama isiku (lepingupooled) vahel, millega lepingupool kohustub või lepingupooled kohustuvad midagi tegema või tegemata jätma. VÕS § 9 lg 1 sätestab, et leping sõlmitakse pakkumuse esitamise ja sellele nõustumuse andmisega, samuti muul viisil vastastikuste tahteavalduste vahetamise teel, kui on piisavalt selge, et lepingupooled on saavutanud kokkuleppe. Isikutel ei ole kohustust lepingu sõlmimiseks, kui selline kohustus ei ole sätestatud seadusega. Antud olukorra puhuks niisugust kohustust sätestatud ei ole. Kauplejal ei ole kohustust tarbijaga lepingu sõlmimiseks.
