OtherKaupleja teabe esitamise viisist: parkimistasu 1,00€/iga alustatud tund; 3,00€/24h ja 30,00€/kuu, on aru saada, et parklas avaldatud hindu kohaldatakse olukorras, kus sõiduk pargitakse antud parklasse üks kord. Ehk seda hinda rakendatakse, kui tarbija alustab näiteks m-parkimist. Tarbija on seisukohal, et kaupleja peaks rakendama samu hindu, mis on ühekordsele parkimisele ka muudes parkimisteenuse kasutamise lepingutes. Tarbija on seisukohal, et hinnakirjast tulenevalt parklas on aru saada, et kui sõidukit pargitakse ühes parklas kuu jooksul mitu korda, siis on maksimaalne parkimise hind 30 eurot. Parkimistingimused ei ole arusaadavad tarbija esitatud viisil. On aru saada, et mõeldud on ühe parkimise hinda. Tulenevalt esitatud asjaoludest ei ole tarbijal tekkinud alust nõuda kauplejale tasutut tagasi. Kaupleja ei ole lepingut rikkunud ja tarbija on parkimise eest tasunud vastavalt lepingutingimustele. Asjaolu, et kauplejaga on võimalik sõlmida leping ka teistsugustel tingimustel, kui parklas avaldatud, ei ole õigusvastane. Kaupleja võib pakkuda samas kohas parkimise õigust erinevatel tingimustel.
