Decision:Tarbija kahjuks
Other6.12.2023 ostis tarbija kauplejalt uue autoaku. Tarbija väitel oli selle akuga kohe algusest peale probleeme, sest auto käivitus halvasti. Kaupleja poole pöördus tarbija alles 24.05.2025, pärast seda, kui oli ostnud kolmandalt isikult uue aku. Tarbija soovis uue aku hinna hüvitamist kaupleja poolt. Kaupleja väitel kontrollis ta akut pärast pretensiooni saamist ning veendus, et aku on korras, vaatamata selle kohutavale seisukorrale (aku oli poriga kaetud). Kauplejale jääb arusaamatuks, miks ootas klient 1,5 aastat enne kui pöördus pretensiooniga nende poole. Kaupleja osundab võlaõigusseaduse (VÕS) §-ile  § 220 lõikele 1, mille kohaselt   ostja peab teatama asja lepingutingimustele mittevastavusest müüjale mõistliku aja jooksul pärast seda, kui ta asja lepingutingimustele mittevastavusest teada sai või pidi teada saama. Tarbijalemüügi puhul peab tarbija teatama asja lepingutingimustele mittevastavusest müüjale kahe kuu jooksul pärast seda, kui ta sai mittevastavusest teada.Komisjon osundas, et kuna ostu sooritamisest on möödas enam kui üks aasta, siis peab vastavalt VÕS § 218 lg 2 tarbija tõendama puuduse olemasolu; seda tarbija antud juhul teinud ei ole. Vastupidi – kaupleja on tõendanud, et tarbija on aku kasutamisel olnud hooletu – on kasutanud seda mudakihiga kaetud olekus. Mudakiht tekitab pinnalekkevoolu, mis kiirendab aku tühjenemist. Komisjon jättis avalduse rahuldamata.
