OtherVÕS § 223 lg 5 kohaselt ostja saab müügilepingust taganeda, kui lepingutingimustele mittevastavus on oluline. Tarbijalemüügi korral eeldatakse, et lepingutingimustele mittevastavus on oluline. VÕS § 223 lg 1 p 3 kohaselt ostjal on õigus müügilepingust taganeda, kui mis tahes lepingutingimustele mittevastavus ilmneb hoolimata müüja püüdlusest asi lepingutingimustega vastavusse viia. Antud juhul Kaupleja võttis jalatsid parandusse, kuid analoogne probleem ilmnes pärast jalatsite parandusest kättesaamist. Seega jalatsite parandus ei andnud tulemusi. Arvestades eeltoodut oli Tarbija õigustatud lepingust taganema ja nõudma ostuhinda tagasi.
