Decision:Tarbija kahjuks
OtherTarbija ostis 03.08.2023 kauplejalt sõiduauto Porsche 718 Cayman GT4 RS ning tasus selle eest 180 000 eurot. Tarbija mainis, et suulise vestluse käigus esitleti autot uuena. Kui tarbija autot registreerida soovis, sai ta teada, et tegu oli juba 27.02.2023 registreeritud ning kasutatud autoga. Tarbija soovis hinnaalandust ja garantii pikendamist 6 kuu võrra.. Kaupleja ei nõustunud tarbija nõudega ning selgitas, et sõiduki müügikuulutusel oli märge, et sõiduk on esmaregistreeritud veebruaris 2023. Kaupleja selgitas, et sõiduki garantiid saab pikendada üksnes tootja või sõiduki ametlik esindus. Komisjon leidis, et avaldus tuli jätta rahuldamata. Materjalidest nähtus, et sõiduki müügikuulutustel oli selgesõnaliselt kirjas, et sõiduki esmaregistreerimine toimus veebruaris 2023. Seega ei olnud usutav tarbija väide, et ta sai sõiduki varasemast registreerimisest teada alles siis kui ta soovis sõidukit Luksemburgis registreerida. Eeltoodust tulenevalt oli komisjon seisukohal, et kaupleja müüs tarbijale sellise sõiduki, milles pooled kokku leppisid ning kaupleja ei rikkunud poolte vahel sõlmitud müügilepingut. Tarbija nõuet garantii pikendamise osas ei saaks kaupleja täita isegi siis kui eelnev nõue kuuluks rahuldamisele. Sõiduki garantii annab tootja tehas või tootjaga kokkuleppel ametlik margiesindus. Komisjon jättis tarbija avalduse rahuldamata.
