OtherTarbija ja Kaupleja sõlmisid müügilepingu elamu kohta ning Tarbija nõuab Kauplejalt elamuga seotud dokumentide (projektid) üleandmist ning garantiitööde teostamist, alternatiivselt esitas Tarbija kahjunõude. Komisjon rahuldas Tarbija avalduse osaliselt, st kohustas Kauplejat andma Tarbijale üle müügilepingus nimetatud dokumendid. Komisjon jättis rahuldamata garantiitööde teostamise nõude, sest Tarbija nõudeõigus ei olnud tekkinud ja kahjunõude, sest kahju tekkimine ei olnud tõendatud.
