OtherPooled sõlmisid töövõtulepingu. Kaupleja on töö teinud osaliselt, jättes ventilatsiooniseadme paigaldamata, tarbija on selle eest tasunud ettemaksuna seadme maksumuse 1636€ +km. Kaupleja ei ole kaebusele vastanud. Vaidluste kohtueelsel lahendamisel kohalduvad analoogia korras põhimõtted, mis tsiviilkohtus vaidluste lahendamisel. Poolel, kes mingi asjaolu esitab, tuleb see tõendada (TsMS § 230). Kui kaupleja tarbija avaldusele ei vasta, siis loetakse kõik tarbija esitatud asjaolud kaupleja poolt omaks võetuks (TsMS § 407 lg 1). Kaupleja on lepingut rikkunud (VÕS 100) jättes lepingu täitmata (VÕS 641 lg 2 p1-2). Kaupleja rikkumine on põhjustanud tarbijale kahju, tekkinud kahju ja rikkumine on põhjuslikus seoses. Rikkumist vabandavaid ega vastutust välistavaid asjaolusid ei esitatud. Avalduse asjaolud ja kahju suurus on tarbija poolt tõendatud. Tarbija kasutas VÕS § 655 lg 1-2 sätestatud tellija ülesütlemisõigust, kuna ülesütlemine toimus seoses kaupleja rikkumisega, ei ole kauplejal õigust lepingutasule tegemata töö eest. Selle ettemakse tuleb vastavalt VÕS § 189 lg 1 kauplejal tarbijale viivitamatult tagastada.
