Tarbija väidab, et arveid 92217, 92825 ja 95264 ei ole talle esitatud. Komisjon selgitab tarbijale, et tasunõude tekkimise aluseks on tehtud töö, mida poolte kokkuleppe alusel mõõdetakse kulutatud ajaga. Tasu muutub sissenõutavaks töö tegemisega. Tasunõude raamatupidamislik kajastamine on eelkõige avalik-õiguslik kohustus, mida tuleb korrektselt täita, kuid sellega seonduv ei oma tasunõude tekkimisele määravat tähendust.

OtherTarbija sõlmis kauplejaga käsunduslepingu, mille raames pidi kaupleja esindama tarbijat haldusasjas. Tarbija andis volituse kuueks kuuks. Kohtulahend ei olnud tarbijale soodne. Tarbija palus kauplejalt e-kirjaga selgitusi, et millised oleksid apellatsioonkaebuse alused. Kuna kaupleja ei teatanud tarbijale, millistele argumentidele tuginedes saaks loota apellatsioonkaebuse edule, võttis tarbija ka teistelt juristidelt konsultatsioone soovides teada saada menetluse jätkamise prognoose. Kaupleja ei selgita oma vastuses, miks ta jättis tarbija kirja tähelepanuta ning miks ei selgitanud tarbijale kaebuse esitamise vajadust põhistavaid aluseid. Komisjon arvates ei täitnud kaupleja tarbija selgitamispalve ignoreerimisel VÕS § 620 lg-s 1 toodud kohustusest, millise kohaselt peab käsundisaaja käsundi täitmisel tegutsema käsundiandjale lojaalselt ja käsundi laadist tuleneva vajaliku hoolsusega. Tarbija poolt antud volitus ei sisaldanud automaatset õigust esitada ilma tarbijaga kooskõlastamata ja teda teavitamata apellatsioonkaebust.

Füüsiliste isikute õigusnõustamise toetuse konkursi võitja teade
Avaldamise algus: 23.04.2021

Justiitsministeerium avaldab teadaande justiitsministri 15.02.2021 määruse nr 4 „Riigi toetatav õigusnõustamine“ § 10 lõike 4 (edaspidi määrus) alusel.

Justiitsministeerium kuulutas justiitsministri 01.03.2021 käskkirjaga nr 20 „Õigusalase esmanõustamise kättesaadavuse parandamise tagamiseks toetuse jagamise konkurss“ (edaspidi käskkiri) välja konkursi. Konkursile taotluste esitamise tähtaeg oli 28.03.2021. a kell 23:00.
 
Lähtudes määruse §-st 9, justiitsministri 01.03.2021 käskkirjaga nr 20 „Õigusalase esmanõustamise kättesaadavuse parandamise tagamiseks toetuse jagamise konkurss“ ning taotluste hindamise ja võrdlemise kohta koostatud komisjoni 19.04.2021 protokollis esitatud ettepanekust, otsustab justiitsminister: 
 
1. kuulutada konkursi võitjaks taotluse esitanud OÜ HUGO (registrikood: 12821618), asukoht: Endla tn 15, Tallinn 10122 ning anda taotlejale toetus taotluses esitatud pakkumise ulatuses;
 
2. Sõlmida konkursi võitjaga toetuse kasutamiseks leping tähtajaga kuni 30.04.2024, võimalusega lepingut samadel tingimustel kuni 2 aasta võrra pikendada;

3. jätta ülejäänud konkursile esitatud taotlused rahuldamata.
 
Konkursi võitja väljakuulutamise aluseks oleva määruse ja selles sätestatud hindamise kriteeriumitega saab tutvuda Riigi Teataja kodulehel. Justiitsministeeriumi veebilehel on võimalik tutvuda konkursi väljakuulutamise käskkirjaga, konkursi võitja väljakuulutamise käskkirjaga ning taotluste hindamise ja võrdlemise kohta koostatud komisjoni protokolliga.

Füüsiliste isikute õigusnõustamise toetuse konkursi võitja teade

Justiitsministeerium avaldab teadaande justiitsministri 05.01.2017 määruse nr 1 „Üldise õigusnõustamise sihtgrupp ja õigusvaldkonnad ning selle nõustamise kättesaadavuse parandamiseks antava toetuse jagamise tingimused ja kord“ § 14 lõike 4 (edaspidi määrus) alusel.

Justiitsministeerium kuulutas justiitsministri 11.01.2017 käskkirjaga nr 12 „Üldise õigusnõustamise kättesaadavuse parandamise tagamiseks toetuse jagamise konkurss“ (edaspidi käskkiri) välja konkursi. Konkursile taotluste esitamise tähtaeg oli 12.02.2017. a kell 23:00.
 
Lähtudes määruse §-st 13, justiitsministri 11.01.2017 käskkirjast nr 12 „Üldise õigusnõustamise kättesaadavuse parandamise tagamiseks toetuse jagamise konkurss“ ning taotluste hindamise ja võrdlemise kohta koostatud komisjoni 22.02.2017 protokollis esitatud ettepanekutest, otsustab justiitsminister: 
 
1. kuulutada konkursi võitjaks ühise taotluse esitanud Eesti Õigusbüroo OÜ (registrikood: 12821618), asukoht: Pärnu mnt 20, 10141 Tallinn; OÜ Kivar & Partnerid (registrikood: 11121474), asukoht: Uus tn 24, Tallinn 10111 ning anda ühistele taotlejatele toetus taotluses esitatud pakkumise ulatuses;
 
2. Sõlmida konkursi võitjaga toetuse kasutamiseks leping tähtajaga kuni 31.03.2020, võimalusega lepingut samadel tingimustel kuni 2 aasta võrra pikendada;

3. jätta ülejäänud konkursile esitatud taotlused rahuldamata.
 
Konkursi võitja väljakuulutamise aluseks oleva määruse ja selles sätestatud hindamise kriteeriumitega saab tutvuda Riigi Teataja kodulehel. Justiitsministeeriumi veebilehel on võimalik tutvuda konkursi väljakuulutamise käskkirjaga, konkursi võitja väljakuulutamise käskkirjaga ning taotluste hindamise ja võrdlemise kohta koostatud komisjoni protokolliga.
