OtherTarbija oli ostnud lennupiletid endale ja pereliikmetele marsruudil Gällivare-Stockholm. Lend pidi aset leidma 11.08.2022, kuid 3 tundi enne lennu algust andis kaupleja tarbijale teada, et lend on tühistatud. Tarbija nõudis määruse 261/2004 artikli 7 lõike 1 punktis a sätestatud hüvitist. Komisjon tuvastas, et määruses 261/2004 sätestatud lennuettevõtja teavituskohustus on täidetud mittenõuetekohaselt. Seetõttu kuulub tarbija nõue rahuldamisele.

OtherReisija oli ostnud edasi-tagasi reisi Stockholmi ja Gällivare vahel, mis tühistati. Lennuettevõtja korraldas tarbijale uue lennupileti samal päeval toimunud lennule Stockholmi ja Kiruna. Õigesse sihtkohta jõudmiseks pidi tarbija võtma takso. Lisaks eeltoodule ei laetud asenduslennule tarbija ära antavat pagasit, mistõttu sai tarbija oma pagasi kätte 24 tundi peale sihtkohta jõudmist. Tarbija soovis ebamugavuste tõttu EI määruse 261/2004 alusel hüvitist. Komisjon leidis, et lennuettevõtjal on kohustus maksta hüvitist reisijale lennu tühistamise, taksosõidu ja pagasi hilinemise eest.

OtherTarbija kasutas lennupiletite broneerimisel istekohtade eelreserveerimise teenust, soovide istekohta varuväljapääsu juures. Lennuki vahetuse tõttu opereeris lendu väiksem lennuk, istekohtade read olid nihkes ja tarbija valitud koht ei osutunud olevaks varuväljapääsu juures. Tarbija soovis eelreserveerimise tasu tagastamist. Komisjoni hinnangul kaupleja ei ole tarbijaga sõlmitud lepingut rikkunud. Komisjon tuvastas, et istekohta saab valida mitme kriteeriumi alusel. Tarbija valis istekoha numbri, kuid ei teinud valikut varuväljapääsu juures paiknemise kriteeriumi alusel. Otsusele on lisatud komisjoni liikme eriarvamus, mille kohaselt on tarbija astunud lepingulisse suhtesse kauplejaga PLL LOT Polish Airlines, mitte Nordic Aviation Group AS-iga. 28.01.2025 kohtumäärusega tsiviilasjas nr 2-24-18178/19 kuulutati välja võlgniku, Aktsiaselts Nordic Aviation Group (registrikood: 12927848),  pankrot 28.01.2025 kell 10:00.

Pankrotihalduriks nimetati vandeadvokaat Tarmo Peterson ja Indrek Lepsoo (aadress Advokaadibüroo RASK, Rotermanni 8, 10111 Tallinn; Roseni 7, 10111 Tallinn, telefon 618 0820; 50 97 167 , e-post pankrotimenetlus@rask.ee; indrek@pankrotihaldur.ee).

Esimene võlausaldajate üldkoosolek toimub 27.02.2025 algusega kell 11:00 Harju Maakohus Tallinna kohtumaja saalis nr 4006 ja virtuaalselt. Võlausaldajatel pöörduda ruumi ID ja PIN saamiseks pankrotihalduri poole.

Võlausaldajad on kohustatud hiljemalt kahe kuu jooksul pankrotiteate väljaandes Ametlikud Teadaanded ilmumise päevast teatama pankrotihaldurile kõigist oma enne pankroti väljakuulutamist tekkinud nõuetest võlgniku vastu, sõltumata nõude tekkimise alusest ja nõude tähtajast (PankrS § 93 lg 1). Tähtaegselt esitamata, kuid tunnustatud nõuded rahuldatakse viimases järgus (PankrS § 153 lg 1 p 3). Pankrotivarasse kuuluva võlgnikule võlgnetava kohustuse täitmist võib pärast pankroti väljakuulutamist vastu võtta üksnes pankrotihaldur (PankrS § 37).
 
Pankrotimäärus kuulub viivitamatule täitmisele (PankrS § 31 lg 7). Võlgnik ja pankrotiavalduse esitanud võlausaldaja võivad esitada määruskaebuse 15 päeva jooksul teate avaldamisest arvates (PankrS § 32). Määruskaebuse esitamine ei peata määruse täitmist (PankrS § 5 lg 3). Pankrotimääruse täitmist ei saa peatada ega ajatada, samuti ei saa muuta pankrotimääruse seaduses sätestatud täitmise viisi ja korda (PankrS § 31 lg 7).
