OtherTarbija tellis Kaupleja e-kauplusest alfashop.ee sidevahendi abil miniköögi ning tasus selle eest. Kauba kättesaamisel selgus, et kaup ei vasta tellitule, kuna erineb kauba müügipakkumise juures olnud fotost. Tarbija taganes lepingust. Kaupleja ei tagastanud Tarbijale kauba tagastamise kulu, kuna selgitas, et kauba juures olnud foto on illustratiivse tähendusega. Komisjoni hinnangul on Kaupleja lepingut rikkunud andes üle asja, mis ei vasta müügipakkumisel olnud infole. Teave foto illustratiivsusest ning miniköögi osade kombineerimise võimalustest oleks pidanudolema toote juures selgelt välja toodud.
