OtherPoolte vahel oli sõlmitud müügileping, mille esemeks oli rulookardinad. Lepingust taganemise põhjusena tugines tarbija lepingu rikkumisele - kaupleja jättis tellimuse tähtaegselt täitmata. Komisjon luges tõendatuks, et poolte vahel oli sõlmitud leping ning asjaolu, et tarbija tasus kauplejale kokkulepitud ettemaksu.
