Harju Maakohus Tallinna kohtumaja avaldab teadaande pankrotiseaduse (PankrS) § 17 lõike 2 ja § 21 lõike 1 alusel.

18.12.2019 kohtumäärusega tsiviilasjas nr 2-19-17380 võeti võlausaldaja avaldus võlgniku Inter Management OÜ (registrikood: 14220610, aadress: Võru maakond, Setomaa vald, Värska alevik, Silla tn 6, 64001)  pankroti väljakuulutamiseks menetlusse.

18.12.2019 kohtumäärusega tsiviilasjas nr 2-19-17380 määrati kohtuistungi toimumise ajaks 14.01.2020, algusega kell 09:30 Harju Maakohtu Tallinna Kohtumaja saalis nr 4020, IV korrus.

Keelata võlgnikul ajutise pankrotihalduri nõusolekuta kogu vara käsutada (PankrS § 20 lg 1). RESOLUTSIOON
1. Nimetada võlgniku Korralduspunkt MTÜ (registrikood 80547296) ajutiseks pankrotihalduriks Martin Krupp (Cavere Õigusbüroo OÜ, Estonia pst 1, Tallinn, e-post martin@cavere.ee).

2. Määrata kohtuistung pankrotiavalduse läbivaatamiseks 14.01.2020 kell 09:30 (Harju Maakohus, Lubja 4, Tallinn, saal 4020).

3. Kohtuistungile kutsuda menetlusosalistena võlausaldajad, võlgnik ning ajutine pankrotihaldur.

4. Peatada võlgniku vara suhtes toimuv sundtäitmine.

5. Keelata võlgnikul ilma ajutise pankrotihalduri nõusolekuta vara käsutada.

6. Teha ajutisele pankrotihaldurile ülesandeks:
selgitada välja võlgniku vara, sealhulgas võlgniku kohustused, ning kontrollida, kas võlgniku vara katab pankrotimenetluse kulud;
anda hinnang võlgniku varalisele seisundile ja maksejõulisusele, samuti võlgniku ettevõtte tegevuse jätkamise ja juriidilisest isikust võlgniku tervendamise väljavaadetele;
selgitada välja võlgniku vara puudutavad täitemenetlused;
tagada võlgniku vara säilimine;
anda võlgnikule nõusoleku vara käsutamiseks või keelduda sellest;
vajadusel taotleda kohtult pankrotiavalduse tagamise abinõude rakendamist.

7. Ajutisel pankrotihalduril on oma ülesannete täitmiseks õigus:
1) saada võlgnikult vajalikku teavet ja dokumente, eelkõige võlgniku vara ja kohustuste kohta;
2) viibida võlgniku valduses oleval maatükil ja majandus- või kutsetegevuseks kasutatavates ruumides;
3) saada riigi- ja kohaliku omavalitsuse asutuselt ning krediidiasutuselt, samuti muult isikult teavet ja dokumente, mis on vajalikud võlgniku varalise seisundi väljaselgitamiseks.
Kui võlgnik on raamatupidamiskohustuslane, on ta kohustatud ajutise halduri nõudmisel esitama talle eelmise majandusaasta aruande koos ülevaatega võlgniku finantsseisundi, majandustulemuste ja rahavoogude kohta ajutise halduri nimetamise päeva seisuga.

8. Ajutisel pankrotihalduril tegutseda pankrotimenetluse ettevalmistamisel pankroti¬seaduse (PankrS) § 22 lg-te 2-5 järgi ning esitada hiljemalt 13.01.2020 kohtule kirjalik aruanne koos kõikide lisadega ja arvamus võlgniku maksejõuetuse tekkimise põhjuste kohta.

9. Avaldada väljaandes Ametlikud Teadaanded teade käsutuskeelu kehtestamise ning pankrotiasja läbivaatamise aja ja koha kohta.

10. Saata määrus võlausaldajale, võlgnikule, ajutisele haldurile ja Tartu Maakohtu registriosakonnale.

11. Käesolev määrus on ajutisele pankrotihaldurile tema volitusi tõendavaks dokumendiks.
