OtherVÕS § 222 lg 1 kohaselt kui asi ei vasta lepingutingimustele, võib ostja nõuda müüjalt asja parandamist või asendamist, kui see on võimalik ja sellega ei põhjustata müüjale võrreldes teiste õiguskaitsevahendite kasutamisega ebamõistlikke kulusid või põhjendamatuid ebamugavusi, arvestades muu hulgas asja väärtust, lepingutingimustele mittevastavuse olulisust ning ostja võimalust saada lepingutingimustele vastav asi oluliste ebamugavusteta mujalt. Esitatud tõenditest ilmneb, et Tarbija pöördus Kaupleja poole ilmnenud puuduse kõrvaldamiseks, kuid Kaupleja puuduse ei kõrvaldanud ning ei pakkunud ka asendust. Seejärel Tarbija taganes lepingust. Lepingust taganemise õiguslikuks aluseks saab olla Kauplejapoolne lepingutingimuste oluline rikkumine (VÕS § 116 lg 1). Kehtinud VÕS § 223 lg 2 kohaselt tarbijalemüügi puhul loetakse oluliseks lepingurikkumiseks ka müüja poolt asja parandamisest või asendamisest keeldumist või kui ta seda ei tee mõistliku aja jooksul pärast talle lepingutingimustele mittevastavusest teatamist. Käesolevas asjas on pretensiooni esitamisest möödunud viis kuud. Seega on ületatud mõistlik aeg puuduse kõrvaldamiseks. Tarbija on õigustatud VÕS § 223 lg 2 alusel lepingust taganema ja nõudma ostuhinda tagasi, milleks on 720 eurot.

Menetlusosalisele Bürookeskus OÃœ (registrikood: 14527900) toimetatakse kätte 09.08.2018 korraldus nr 12.2-3/045167-1 kus Maksu- ja Tolliamet on kohustanud Bürookeskus OÜ´d 22.08.2018 kell 13:30 andma teavet ja hiljemalt 21.08.2018 esitama tõendid ettevõtlusega tegelemise kohta Maksu- ja Tolliametile aadressil Lõõtsa 8a, 15176 Tallinn.

Dokumendi resolutiivosa loetakse kättetoimetatuks kümne päeva möödumisel käesoleva teadaande avaldamisest (MKS § 55).
