Tartu Maakohtu registriosakond avaldab teadaande tsiviilkohtumenetluse seadustiku (TsMS) § 317 lõike 3 alusel.

Kohus toimetab isikule, Tartu linn, Tiigi tn 6 korteriühistu (registrikood: 80129145), avalikult kätte 18.12.2020 määruse nr Ü 20018615 / 19 väljavõtte:
Avaldada väljaandes Ametlikud Teadaanded järgmise sisuga avalikult kättetoimetatava määruse Ü 20018615 / 19 väljavõte: Tartu Maakohtu registriosakonnas 18.12.2020 Tartu linn, Tiigi tn 6 korteriühistule (registrikood 80129145) tehtud eitava kandemäärusega Ü 20018615 / 19 jäeti 03.12.2020.a esitatud kandeavaldus põhikirja muutmise aja osas rahuldamata.
Kohtunikuabi tegi kindlaks, et 03.12.2020 esitatud kandeavalduse alusel ei saa teha korteriühistute registrisse taotletud põhikirja kinnitamise aja 23.10.2020 a kannet, sest avaldusele ei ole lisatud 23.10.2020 a põhikirja muutmise aluseks olevaid dokumente. Avaldusele on lisatud 31.10.2020 a koostatud hääletusprotokoll ja 31.10.2020 a kinnitatud põhikirja tekst. Esitatud 31.10.2020 a koostatud hääletusprotokolli punkti 9 kohaselt: Hääletan otsuse eelnõu, kinnitada Tartu linn, Tartu Tiigi 6 KÜ korteriühistu põhikiri
Poolt 74 korteriomaniku, Vastu 2 korteriomaniku Kuna kehtiva Tartu Tiigi 6 KÜ põhikirja kohaselt põhikirja punkt 6.2.16 alljärgnev:
6.2.16 Üldkoosoleku otsused võetakse vastu Liikmete lihthäälteenamusega. Otsused põhikirja muutmise, täiendamise ja uue põhikirja vastuvõtmise ning reorganiseerimise ja lõpetamise kohta ning muudel käesolevas põhikirjas ette nähtud juhtudel võetakse vastu Liikmete vähemalt 2/3 poolt häälteenamusega. KÜ Tartu Tiigi 6 on 145 hääleõigulikku liiget. Uue põhikirja vastuvõtmiseks on vajalik 2/3 Liikmete poolt hääli milleks 97 poolt häält, paraku hääletati 74 poolt häält uue põhikirja poolt.
Otsustati: Mitte kinnitada uut põhikirja kuna puudub vajalik 2/3 Liikemete poolt hääli ehk 97 häält. 03.12.2020 määrusega anti registriasjas Ü 20018615 / M12 kande tegemist takistavate puuduste kõrvaldamiseks tähtaeg kuni 17.12.2020. Kande tegemist takistavaid puudusi tähtajaks ei kõrvaldatud. Kui avalduses on kande tegemist takistav puudus või kui puudub vajalik dokument ja puudust on ilmselt võimalik kõrvaldada, määrab kohus tähtaja puuduse kõrvaldamiseks. Kui puudust tähtaja möödumise ajaks kõrvaldatud ei ole, jätab kohus avalduse kandemäärusega rahuldamata (tsiviilkohtumenetluse seadustiku § 596 lg 2).
Lähtudes eeltoodust ja juhindudes tsiviilkohtumenetluse seadustiku § 596 lõikest 2 otsustas kohtunikuabi jätta Tartu linn, Tiigi tn 6 korteriühistu 03.12.2020 esitatud kandeavaldus põhikirja muutmise aja osas rahuldamata.
Määruse peale võib esitada määruskaebuse Tartu Ringkonnakohtule Tartu Maakohtu registriosakonna kaudu 15 päeva jooksul alates määruse kättetoimetamisest. Riigilõivuseaduse § 59 lõike 14 kohaselt tasutakse määruskaebuse esitamisel riigilõivu 50 eurot. Lõiv tuleb tasuda Rahandusministeeriumi arveldusarvele Swedbank a/a EE062200221059223099, AS SEB Pank a/a EE571010220229377229, Luminor Bank AS a/a EE221700017003510302, LHV Pank a/a EE567700771003819792. Maksekorraldusel tuleb märkida viitenumber 11170021611601.
Dokument loetakse avalikult kättetoimetatuks 15 päeva möödumisel väljavõtte väljaandes Ametlikud Teadaanded ilmumise päevast.
