Kohus toimetab isikule, Mittetulundusühing JCI e-KODA (registrikood: 80132997), avalikult kätte 25.04.2017 määruse nr M 10051531 / 20 väljavõtte:
Avaldada väljaandes Ametlikud Teadaanded järgmise sisuga avalikult kättetoimetatava määruse M 10051531 / 20 väljavõte: Tartu Maakohtu registriosakonnas 25.04.2017 Mittetulundusühing JCI e-KODA (registrikood 80132997) tehtud eitava kandemäärusega M 10051531 / 20 jäeti 06.03.2017.a esitatud kandeavaldus uute juhatuse liikmete kande osas rahuldamata.
Kohtunikuabi tegi kindlaks, et 06.03.2017 esitatud kandeavalduse alusel ei saa teha mittetulundusühingute ja sihtasutuste registrisse taotletud uute juhatuse liikmete andmete kannet, sest kandeavaldust ei ole
allkirjastanud uued juhatuse liikmed ja kande aluseks esitatud 11.11.2016 a üldkoosoleku protokollis ei ole märgitud hääletustulemusi. 29.03.2017 määrusega anti registriasjas M 10051531 / M14 kande tegemist takistavate puuduste kõrvaldamiseks tähtaeg kuni 18.04.2017. Nimetatud tähtajaks kande tegemist takistavaid puudusi ei kõrvaldatud. 1. Uue juhatuse liikme registrisse kandmise avaldusele kirjutab alla uus juhatuse liige, kes peab avalduses kinnitama, et tal on seaduse kohaselt õigus olla juhatuse liige (mittetulundusühingute seadus § 8 lg 2). Registripidajale esitatav avaldus peab olema notariaalselt kinnitatud (mittetulundusühingute seadus § 79 lg 2) või digitaalallkirjastatud (mittetulundusühingute seadus § 79 lg 3.1) . Registripidajale esitatavale avaldusele alla kirjutama õigustatud isik võib volitada alla kirjutama teist isikut. Avaldusele allakirjutamiseks antud volikiri peab olema notariaalselt kinnitatud (mittetulundusühingute seadus § 79 lg 3) või digitaalallkirjastatud (mittetulundusühingute seadus § 79 lg 3). 2. Mittetulundusühingute seaduse § 10 lg 3 ja 4 kohaselt tuleb avaldusele lisada muutmise otsustanud üldkoosoleku või muu organi koosoleku protokoll või väljavõte protokollist. Protokolli väljavõtte sisule, allkirjastamisele ja väljavõttele lisatavatele dokumentidele kohaldatakse vastava organi koosoleku protokolli kohta sätestatut. Protokolli kantakse üldkoosoleku toimumise aeg ja koht, üldkoosoleku päevakord,
hääletustulemused ja vastuvõetud otsused ning muud üldkoosolekul tähtsust omavad asjaolud. Protokolli kantakse ka üldkoosoleku otsuse suhtes eriarvamusele jäänud liikme nõudel tema eriarvamuse sisu. Protokollile kirjutavad alla üldkoosoleku juhataja ja protokollija. Eriarvamusele kirjutab alla selle esitanud isik. Protokolli lahutamatuks lisaks on üldkoosolekust osavõtnute nimekiri koos igaühe allkirjaga ning üldkoosolekule esitatud kirjalikud ettepanekud ja avaldused (Mittetulundusühingute seadus § 21 lg 6). Kui koosolekul osales ka liikmete esindajad, tuleb protokollile lisada ka volikirjad (Mittetulundusühingute seadus § 21 lg 5). Kandeavaldust registrisse kantud andmete muutmiseks põhistatakse dokumentidega, mis tuleb
lisada kandeavaldusele. Kannet ei saa teha, kui kandeavaldus ja seda põhistav dokument ei vasta seaduse nõuetele. Registripidaja kontrollib seadusega sätestatud vormi- ja sisunõuete järgimist esitatavates dokumentides (Riigikohtu 04.02.2009. a määrus nr 3-2-1-139-08). Registripidaja keeldub kande tegemisest, kui avaldus või sellele lisatud dokumendid ei vasta seadusele (MTÜS § 79 lg 5). Kui avalduses on kande tegemist takistav puudus või kui puudub vajalik dokument ja puudust on ilmselt võimalik kõrvaldada, määrab kohus tähtaja puuduse kõrvaldamiseks. Kui puudust tähtaja möödumise ajaks kõrvaldatud ei ole, jätab kohus avalduse kandemäärusega rahuldamata (tsiviilkohtumenetluse seadustiku § 596 lg 2). Lähtudes eeltoodust ja juhindudes tsiviilkohtumenetluse seadustiku § 596 lõikest 2 otsustas kohtunikuabi jätta avaldus rahuldamata.
Käesoleva määruse peale võib esitada määruskaebuse 15 päeva jooksul alates määruse kättetoimetamisest. Vastavalt riigilõivuseaduse § 59 lõikele 14 tasutakse määruskaebuse esitamisel riigilõivu 50 eurot. Lõiv tuleb tasuda Rahandusministeeriumi arveldusarvele Swedbank a/a EE062200221059223099, AS SEB Pank a/a EE571010220229377229, Danske Bank A/S Eesti filiaalis a/a EE513300333522160001, Nordea Bank AB Eesti Filiaalis a/a EE221700017003510302. Maksekorraldusel tuleb kindlasti märkida viitenumber 11170007602977.
Dokument loetakse avalikult kättetoimetatuks 15 päeva möödumisel väljavõtte väljaandes Ametlikud Teadaanded ilmumise päevast.
