Kohtu registriosakonna määruse kättetoimetamise teade

Tartu Maakohtu registriosakond avaldab teadaande tsiviilkohtumenetluse seadustiku (TsMS) § 317 lõike 3 alusel.

Kohus toimetab isikule, Mittetulundusühing JESP (registrikood: 80289724), avalikult kätte 05.10.2021 määruse nr M 40024239 / 8 väljavõtte:

Avaldada väljaandes Ametlikud Teadaanded järgmise sisuga avalikult kättetoimetatava määruse M 40024239 / 8 väljavõte: Tartu Maakohtu registriosakonnas 05.10.2021 ühingule Mittetulundusühing JESP (registrikood 80289724) tehtud eitava kandemäärusega M 40024239 / 8 jäeti 13.09.2021.a esitatud kandeavaldus rahuldamata.

Kohtunikuabi tegi kindlaks, et 13.09.2021 esitatud kandeavalduse alusel ei saa teha mittetulundusühingute ja sihtasutuste registrisse ühingu nime, uue põhikirja kinnitamise ja ühe juhatuse liikme kustutamise kannet. Esitatud on 13.10.2021 protokoll juhatuse liikme Allan Valk tagasi kutsumise kohta. 21.09.2021 määrusega nr M 40024239 / M2 anti avaldajale tähtaeg 10 päeva arvates määruse tegemisest kande kande tegemist takistavate puuduste kõrvaldamiseks so esitada õige kuupäevaga otsus alles jääva juhatuse liikme volituste pikendamise ja teise juhatuse liikme tagasi kutsumise kohta. Avaldaja ei ole kande tegemist takistavaid puudusi tähtaegselt so 01.10.2021 kõrvaldanud. Tsiviilkohtumenetluse seadustiku (TsMS) § 596 lg 2 teise lause kohaselt kui puudusi tähtaja möödumise ajaks kõrvaldatud ei ole, jätab kohus avalduse rahuldamata. Kuna avaldaja ei ole kohtu poolt antud tähtajaks puudusi kõrvaldanud, jätab kohus 13.09.2021 kandeavalduse rahuldamata.

Määruse peale võib esitada määruskaebuse Tartu Ringkonnakohtule Tartu Maakohtu registriosakonna kaudu 15 päeva jooksul alates määruse kättetoimetamisest. Riigilõivuseaduse § 59 lõike 14 kohaselt tasutakse määruskaebuse esitamisel riigilõivu 50 eurot. Lõiv tuleb tasuda Rahandusministeeriumi arveldusarvele Swedbank AS a/a EE062200221059223099, AS SEB Pank a/a EE571010220229377229, Luminor Bank AS a/a EE221700017003510302, AS LHV Pank a/a EE567700771003819792. Maksekorraldusel tuleb märkida viitenumber 11170023912450.

Dokument loetakse avalikult kättetoimetatuks 15 päeva möödumisel väljavõtte väljaandes Ametlikud Teadaanded ilmumise päevast.
