Decision:Tarbija kahjuks
Sisu:Tarbija ostis kauplejalt vuugitäidet ning kasutas seda vannitoa remontimisel. Tarbija väidab, et vuugitäide oli ebakvaliteetne, sest see muutub kokkupuutel veega pehmeks ja määrivaks. Tarbija nõudis kauplejalt vuugisegu eest tasutud 18,53 euro tagastamist ja vuugitäite asendamisega seotud kulutuste hüvitamist summas 225 eurot.  Kaupleja ja vuugitäite tootja leidsid, et probleem ei saa olla materjalis; probleem on vuugitäite ebaõiges kasutamises. Komisjon leidis, et tarbija väited on tõendamata ja jättis avalduse rahuldamata.

Sisu:Komisjoni hinnangul oli kaupleja koheselt valmis defektiga plaadid parandama ning paluti tarneaadressi, kuid tarbija ei vastanud kauplejale. Seetõttu jäi tarbija tõttu saadetis koheselt tarnimata. Seega sisuliselt ei ole tarbija andnud võimalust kauplejale viga parandada (kaupleja asus viga parandama ning plaadid olid lubatud ajaks olemas). Sellega on sisuliselt tarbija rikkunud VÕS-s sätestatud heastamise nõuet.

Ühinemisel osalesid aktsiaselts Plaadipunkt (registrikood 10087775) ja Riho Invest OÜ (registrikood: 14482474), asukoht: Harju maakond, Tallinn, Pirita linnaosa, Andrekse tee 4/2-2, 11912. Aktsiaselts Plaadipunkt on ühendav ühing ja Riho Invest OÜ ühendatav ühing. Ühinemine on kantud äriregistrisse 27.08.2018, ühinemisleping on sõlmitud 03.07.2018.

Äriühingute võlausaldajatel palume esitada oma nõuded tagatise saamiseks kuue kuu jooksul käesoleva teate avaldamisest (ÄS § 399 lg 1). Nõuded palume esitada e-posti teel plaadipunkt@plaadipunkt.ee või posti teel Aktsiaselts Plaadipunkt, Pärnu maantee 137, Tallinn, 11317 Harju maakond.
