OtherTarbija nõudis kauplejalt (Herz kaubamärk) 4 000 euro suuruse ettemaksu tagastamist ning lisaks 15% hüvitist tasutud rendimaksetest, kuna sõiduk viibis tema väitel igakuiselt hoolduses. Nõude kogusumma oli 5 896,24 eurot.Komisjon leidis, et leping hõlmas mitte ainult sõiduki üleandmist, vaid terviklikku teenust, mille eesmärk oli tagada sõiduki pidev ja häireteta kasutamine. Kuna sõidukil esines korduvalt rikkeid ja see viibis sageli hoolduses, ei vastanud teenus lepingutingimustele ning kaupleja rikkus lepingut.Tarbija ütles lepingu õiguspäraselt üles kaupleja olulise rikkumise tõttu. Sellisel juhul ei ole kauplejal õigust rakendada leppetrahve ega jätta ettemaksu enda kätte.Komisjon rahuldas tarbija avalduse osaliselt ning kohustas kauplejat tagastama tarbijale ettemaksu summas 4 000 eurot. Ülejäänud nõue jäeti rahuldamata, kuna nõudel puudus alus.
