Decision:Tarbija kahjuks
OtherTarbija ostis kauplejalt kasutatud sõiduauto väljalaskeaastaga 2015 ja läbisõiduga 174 000 km. Tarbija sõitis autoga 20 000 km. Kuna mootorist hakkas kostma võõras hääl, viis tarbija auto kolmanda isiku juurde defekteerimisele. Defekteerimisel leiti, et neljanda kepsu saale ja väntvõlli kepsukael on kahjustunud. Kolmas isik koostas tarbijale remondikalkulatsiooni summas 22 780,27 eurot, mis moodustab ca 75 % auto ostuhinnast. Osundades Riigikohtu praktikale leidis komisjon, et üheksa aastat vanalt ja 175 000 kilomeetrit läbi sõitnud autolt ei saa eeldada samu omadusi, mis uutelt autodelt. Autod ja eriti nende veermiku ning mootori detailid paratamatult kuluvad ning vajavad väljavahetamist. komisjon juhtis tähelepanu ka sellele, et tarbija poolt esitatud hinnapakkumine ei sisaldanud üksnes neljanda kepsu saale ning väntvõlli kepsukaela väljavahetamist, vaid nö kogu mootori alumise osa väljavahetamist.

OtherTarbija sõlmis Kauplejaga müügilepingu tehasegarantiiga sõiduauto KIA ostuks. Neli kuud hiljem selgus, et sõiduki margiesindus (Tartu Autospirit OÜ) nõuab tehasegarantii kehtivuseks sõiduki kontrolli tellimist tasulise lisateenusena summas 300 eurot ning Tarbija nõuab nimetatud summa hüvitamist Kauplejalt. Komisjon tuvastas, et KIA tehasegarantii kehtib ilma tasulise lisakontrollita ja seega ei ole alust summat nõuda Kauplejalt. Kuna Kaupleja nõustus Tarbijale hüvitama sõidukile tehtud pisiremondi kulud, mõistis komisjon need kulud Kauplejalt välja.

OtherTarbija ostis kauplejalt sõiduki. Tarbija sai koos auto ostuga kaasa ka suvrehvid, mis kaupleja sõnade kohaselt pidid olema kasutuskõlblikud. Tarbija viis auto kevadel rehvivahetusse ja selgus, et rehvid ei ole liiklemiseks sobilikud, mistõttu pidi tarbija ostma uued rehvid. Kaupleja seisukohaks on, et tarbijale müüdi korralik vähekasutatud auto, millega anti kaasa kaks komplekti rattaid eraldi velgedel ning rehvid olid kasutatud, kuid rehvide kulumispiir ei olnud veel käes. Komisjon leidis, et avaldus tuleb jätta rahuldamata. Komisjoni hinnangul ei ole rehvid sellised sõiduki osad, millel saaks olla ostja jaoks müügilepingu ajal varjatud ja nähtamatuid puudusi. Sama tavapärane on, et sõiduki rehvid kuluvad ning vajavad aeg ajalt vahetamist. Komisjon on seisukohal, et kaupleja ei ole lepingutingimusi rikkunud ega vastuta asja lepingutingimustele mittevastavuse eest.
