Decision:Tarbija kahjuks
Other13.08.2024 ostis tarbija kauplejalt uue kasutamata sõiduki Škoda Kamiq Monte Carlo. 08.10.2024 sai tarbija ostetud auto kätte. 12.11.2024 leidis tarbija sõiduki kapotil defekti - võimalikud keevitusjäljed, tihendijärjed, mullid. Tarbija pöördus koheselt pretensiooniga kaupleja poole. Kaupleja nõustus puuduse kõrvaldama. Tarbija parandusega ei nõustunud ja soovis sõiduki hinna alandamist 6%. Kaupleja sellega ei nõustunud. Tarbija teatel on ka sõiduki kaassõitja iste defektiga – istme seljatoes on mull, mis on auto sisemuses valguse käes väga hästi nähtav. Kaupleja nõustus istmekatte vahetusega, kuid tarbija seda ei soovi. Seetõttu soovib tarbija 8% sõiduki ostuhinna alandamist. Komisjon nõustus kauplejaga, et tarbija poolt viidatud defekte on võimalik garantiikorras kõrvaldada. Tarbija väited, et kaupleja taastamisel ebaõnnestub või garantiikorras parandused vähendavad sõiduki hinda on paljasõnalised ja tõendamata. Komisjoni hinnangul on tavapärane, et sõidukitel pärast ostu ilmnenud pisivead garantiikorras kõrvaldatakse. VÕS § 107 lg 1 p 1 kohaselt võib lepingulist kohustust rikkunud lepingupool rikkumise omal kulul heastada, muu hulgas mittekohase täitmise parandada või asendada, kuni teine lepingupool ei ole lepingust taganenud, seda üles öelnud või nõudnud kohustuse täitmise asemel kahju hüvitamist kui heastamine on vastavalt asjaoludele mõistlik. VÕS § 224 p 2 kohaselt ei või ostja hinda alandada juhul, kui müüja on jõudnud enne hinna alandamise avalduse tegemist teatada ostjale kavatsusest rikkumine asja parandamise või asendamise teel heastada ning ostja on sellest õigustamatult keeldunud. Heastamise asemel toimuv hinna alandamine põhjustab komisjoni hinnangul müüjale ebaproportsionaalseid kulusid, kuna asja parandamise või asendamise kulu on müüja jaoks oluliselt väiksem kui asja puudusest tingitud väärtuse vähenemine.  Asja garantiikorras parandamise või asendamise korral on müüjal võimalik nõuda kulude hüvitamist tootjalt tootja garantiiprogrammi raames, ent hinna alandamise korral kauplejal regressiõigus puudub. Ülaltoodust tulenevalt leiab komisjon, et praegusel juhul ei olnud hinna alandamise nõue seadusega kooskõlas, mistõttu jättis komisjon avalduse rahuldamata.
